Military Leave The Uniformed Services Employment and Reemployment Rights Act (USERRA) protects employee’s pensions rights and health benefits while on military leave and mandates employers provide reemployment upon return from military leave. USERRA also provides rights to employers. This timely and information-packed Alert will help you understand and administer these protection rights. Employer obligation begins when an employee is called to military duty. USERRA guarantees that military service members, including veterans, reservist, and the National Guard, will not suffer employment discrimination or be denied reemployment rights because of their active duty obligations. With more than 56,000 reservists and National Guard members now on active duty and as many as 250,000 service members possibly called up, it is critical employers understand their obligations under USERRA.
